CoolWatts Terms & Conditions:

Each 200 kWh block of CoolWatts^sm brand renewable certificates represents the environmental attributes of 200 kWh of electricity generated by clean wind electricity generators.

When a renewable energy facility operates, it creates electricity that is delivered into a vast network of transmission wires, often referred to as “the grid.”  The grid is segmented into regional power pools; in many cases these pools are not interconnected. To help facilitate the sale of renewable electricity nationally, a system was established that separates renewable electricity generation into two parts: the electricity or electrical energy produced by a renewable generator and the renewable “attributes” of that generation. The renewable attributes or “green” attributes are sold separately as renewable energy certificates (RECs). Only one certificate may be issued for each unit of renewable electricity produced. The electricity that was split from the REC is no longer considered "renewable" and cannot be counted as renewable or zero-emissions by whoever buys it.

This product is comprised of RECs. With the purchase of RECs, you are buying the renewable attributes (i.e. environmental benefits) of a specific amount and type of renewable energy generation. You will continue to receive a separate electricity bill from your utility. Your purchase of renewable certificates helps offset conventional electricity generation in the region where the renewable generator is located. Your purchase also helps build a market for renewable electricity and may have other local and global environmental benefits such as reduced global climate change and regional air pollution.

The renewable certificates in this product are verified and certified by Green-e Energy. Each supplier of renewable certificates is required to disclose the quantity, type and geographic source of each certificate. Please see the Product Content Label for this information. Green-e Energy also verifies that the renewable certificates are not sold more than once or claimed by more than one party. For each month that you purchase this product, NativeEnergy ensures that electricity is generated from 100% wind generation facilities and delivered to the national power grid in an amount equal to your monthly purchase. This electricity and the associated renewable energy certificates will be generated in the calendar year of your purchase, the first three months of the following calendar year, or the last 6 months of the prior calendar year. To verify this generation and delivery, NativeEnergy will purchase and retire renewable energy certificates on your behalf. Each certificate will be retired once and only once.

How will I be billed?

Your credit card will be billed on a monthly basis, in the amount you approved when you made your TRCs purchase. You will continue to pay your electricity service provider for electricity charges.

 

How will my TRC bill be calculated?

Your cost for CoolWatts^sm is based on the number of kWh you chose to purchase each month times one cent per kWh. For example, if you chose to purchase 200 kWh each month, your monthly charge will be $2.00. You must also pay all applicable federal, state, and local taxes and charges.

 

Will my TRC rates change over time?

Your cost per kWh of CoolWatts^sm renewable energy certificates will not change unless we give you at least 30 days written notice, by e-mail or letter

What fuel sources will be used to generate my TRCs?

100% new wind. Please see the Power Content Label below

 

Length of Agreement and Cancellation

 

Your subscription to purchase CoolWatts^sm will begin on the day we receive your agreement to purchase CoolWatts^sm, and will continue on a month to month basis until you or we cancel. You may cancel at any time and for any reason by giving us 30 days advance notice. You may give us this notice by calling us at 1-800-924-6826, or by writing to us at the address shown under Contact Information. Cancellation of this agreement will not cause any interruption or termination of your electric service. We may cancel this agreement at any time.

 

Not a Purchase of Electricity

This transaction is a purchase of renewable energy certificates, not a purchase of electricity. NativeEnergy will not be providing your electricity service. The price you pay for CoolWatts^sm is in addition to the electricity service charges assessed by your electricity supplier.

 

Limitations of Liability; Disclaimer Of Warranties.

NEITHER YOU NOR NATIVEENERGY WILL BE LIABLE FOR SPECIAL, CONSEQUENTIAL, INCIDENTAL, EXEMPLARY OR PUNITIVE DAMAGES. OUR AND YOUR LIABILITY RELATED TO THE PURCHASE AND SALE OF THIS PRODUCT IS LIMITED TO THE TOTAL PURCHASE PRICE PAID BY YOU. NATIVEENERGY MAKES NO REPRESENTATIONS OR WARRANTYS WHATSOEVER OTHER THAN AS EXPRESSLY STATED IN THIS AGREEMENT, AND HEREBY DISCLAIMS ANY OTHER REPRESENTATION OR WARRANTY, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PURPOSE.

General Terms

These Terms and Conditions state the entire agreement between you and NativeEnergy with respect to the purchase and sale of CoolWatts^sm and may not be amended without the written agreement of both parties. This agreement is governed by the laws of the state of Vermont, without regard to its provisions governing conflicts of laws.
