Des Plaines Landfill Gas Project Located in Cook County, Illinois Located approximately 30 minutes northwest of Chicago, Illinois, in the USA, Des Plaines began as a landfill in the early 1960s, accepting waste until about 1986. The site has a waste footprint of about 130 acres, with an existing waste-in-place volume of about 11.6 million cubic yards. The site was constructed in accordance with practices current at the time operations began. There are no regulations requiring landfill gas (LFG) collection at the Des Plaines Landfill. Collection of LFG was initiated in 1998 and initially destroyed the methane gas through burning the gas in a flare, with the aim to eventually add electric generation fueled by the methane. In 2004, the flare was replaced with a power plant that uses the captured LFG to generate electricity. LFG is the natural byproduct of anaerobic (without air) bacterial activity, which causes the organic matter that exists within landfills to decompose. The emission into the atmosphere of LFG is a major contributor to global warming, accounting for over 35% of the man-made methane gas emissions in the United States. Since methane is a major component of LFG and is also the main component of natural gas, LFG can serve as an alternative to natural gas in order to generate electrical energy. As indicated above, the Des Plaines project now destroys the LFG by burning the gas in engines that drive electrical generators rather than burning it in the flare. The power plant is housed in a building located adjacent to the landfill, and supports electrical generation facilities of 3500 kilowatts. Two internal combustion engines of 1750 kilowatts each turn electric generators to produce and deliver power output for local distribution. Commonwealth Edison purchases all of the output from the facility, which has enough electrical generation to supply the needs of 3500 residents in the immediate area. Billing and Cancellation Purchases from the Paraiso Project are one time purchase. We will not automatically bill you again next year, although we will ask you to renew your purchase at that time. If you cancel your participation within this period, we'll refund any amounts charged to your credit card. If you do cancel, please tell us why. Clean Air - Cool Planet. You are purchasing verified carbon offsets. To have them offset your current CO2 footprint, you need to make sure that the offsets are never sold to someone else later. That’s why we automatically donate all our customers’ offsets to Clean Air-Cool Planet, for retirement. CA-CP has agreed with us that it will accept our customers’ offsets, and that it will not sell or otherwise transfer them, or use them, for any purpose, except to the extent necessary or advisable under applicable law to effect their retirement, such as transfer to a duly constituted government agency for retirement. CA-CP has authorized us to make this representation to you on its behalf. If you purchase offsets from us and donate them to CA-CP through us in reliance on that representation, the representation becomes an enforceable legal obligation. Our agreement with Clean Air - Cool Planet obligates us to convey to it legal title to the offsets our customers donate, and obligates Clean Air - Cool Planet to send an electronic acknowledgement of receipt to each of our customers who provides us an e-mail address, and to mail an acknowledgement to each customer who does not provide an e-mail address and who purchases and donates more than $200 of RECs per purchase. In addition, our agreement with Clean Air - Cool Planet gives them the right to audit our business records, to make sure that we're performing our obligations. Clean Air - Cool Planet is an independent 501(c)(3) non-profit environmental organization. Other Legal Provisions. EXCEPT AS SET FORTH EXPRESSLY IN THESE TERMS AND CONDITIONS, NATIVEENERGY MAKES NO WARRANTIES OF ANY KIND, WHETHER IMPLIED OR EXPRESS, INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE (this disclaimer may not apply in your state). In no event shall either party be liable to the other party for indirect, special, incidental or consequential damages of any kind, including, without limitation, loss of revenues or profits. All damages shall be limited to actual damages only. The agreement set forth in these terms and conditions shall be governed by, and construed and enforced in accordance with, the laws of the State of Vermont, without regard to its provisions governing conflicts of laws. Any dispute arising under this agreement shall be subject to mandatory arbitration in accordance with the rules of the American Arbitration Association, and the arbitrator's decision shall be final and binding upon the parties. All information included on the web pages or pop-ups linked to in these terms and conditions is incorporated into these terms and conditions by this reference, with the same effect as though fully set forth herein.
